In the witness chairs were Under Secretary of the Treasury for Enforcement Jimmy Gurulé and BATF Director Bradley Buckles. In addition to many other budget and management issues, subcommittee members questioned Buckles on two gun issues. First, pro-gun Rep. John E. Sununu (R-N.H.) asked Buckles about the recent BATF regulations requiring import permits for non-immigrant aliens to bring guns into the U.S. Noting that his congressional district in New Hampshire includes large areas of hunting land popular with both U.S. and Canadian residents, Rep. Sununu began by asking Buckles what consultation BATF had with hunting and sporting groups, outfitters, and others affected by the new rules. Buckles replied that before September 11, a hunting license from any state was all that was required to bring a gun into the U.S., and that in tightening the requirement, BATF thought it had reached out to affected parties, but that problems had turned up, and that "perhaps we hadn't reached out the way we thought we had." He also noted that the regulation was also published as a proposed rule so that full opportunity would be provided for public comment. Rep. Sununu noted confusing and conflicting answers that Canadian shooters had received from the U.S. Customs Service about the new rules, and asked Buckles whether Customs had been consulted, and what guidance had been given to Customs for use at border crossings, and what steps could be taken to make the regulations more functional for Canadian visitors. Buckles answered that BATF was "ramping up" its Imports Branch to provide quick processing of permits. He also said he had notified Customs of the new rules, but that upon re-reading his letter to Customs, he thought that it may not have made clear the urgency of the impending changes and may have sounded too routine. Under Secretary Gurulé said that since it was his responsibility to oversee both agencies, he would make sure to sit down with Buckles and Commissioner of Customs Raymond Bonner to ensure that the rules were implemented more smoothly. Rep. Sununu continued by asking whether the current Form 6, designed for permanent commercial importation of guns, was really the best process for temporary visitors. Buckles responded that since their "intent was not to hinder sportsmen" they were working on the process "on an expedited basis," and in response to a follow-up question, suggested it might be possible to complete the paperwork and related background checks at the border. Later, Rep. Don Sherwood (R-Pa.) noted that, as a hunter, he has had no problem taking guns to England, South Africa, and Argentina-all countries with much more restrictive gun laws than ours-and said he hoped that if they could have simple processes for visitors, we could, too. Rep. Sherwood also asked what would happen if Customs confiscated someone's gun at the border due to confusion or lack of information or proper paperwork-could the visitor retrieve it before leaving the U.S.? Buckles said he wasn't aware of anyone having guns confiscated at this point. Members of the Committee will continue the oversight process as the BATF budget request makes its way through the process. Follow-up inquiries from the initial hearing are expected to include a detailed examination of BATF's failures to provide the nation's firearm retailers with the new Form 4473 by the date on which it was mandated to use. Linda ================ Police raid BC Marijuana Party President Marc Emery, In the early hours of March 5, Victoria police quietly surrounded the home of BC Marijuana Party President Marc Emery and his partner Coral Clay, then rang his phone until he awoke to answer it. Emery looked at his clock as he lifted the receiver. 3:30 am. "This is the Victoria Police," said the cop. "We have your house surrounded. We have a warrant to enter the premises. Please go out your front door, do not go back into your house. Out onto the sidewalk. Is there a child in the house?" There was a child in the house. Coral's son, Dylan. The tactics employed by Victoria Police were intentionally intimidating, and the presence of a child may have been the deciding factor in keeping police from kicking in the door and firing tear gas grenades. Marc stumbled out onto the sidewalk in the predawn light in his underwear. Coral was still pulling on her shirt as she hurried out with Dylan to stand beside him. Officers eventually emerged from the darkness with a warrant. "Eight cops sheepishly troop in, because I'm not the least bit disappointed-looking and they know this isn't going to be as juicy as they fantasized," said a scornful Emery. The warrant specified that police were looking for plants, pots, lights, ballasts, capacitor assemblies, fans, blowers, fertilizers, scales, and documentation associated with the production of marijuana. "This young cop, Constable Colin Brown, is doing his best unthreatening 'let me explain why we're here,'" recalled Marc. "When, within a few seconds and a cursory look at our very middle class home with no grow op or anything odd, he realizes his fishing expedition has come up empty." Marc vividly recalls the officer's explanation for the raid: "On Wednesday, I was walking by and smelled pot. So we got a warrant to enter your property to look at your electrical meter, which seemed a bit higher than normal. I smelled what now appears to be your dryer exhaust vent, but I thought I detected the smell of pot coming from it when we executed the earlier warrant Saturday." Search warrants require probable grounds. The "probable grounds" offered by Constable Brown were so unbelievably weak that they cast serious doubt on the already ailing reputation of our justice system, and on the reputation of Justice D Maihara, who signed the warrant. "Since none of [Constable Brown's] assertions turn out to be true, it is obvious that any police officer can get a search warrant by literally lying and making up whatever information they require to get in your house," said Emery. "The terrifying thing is that any pot smoker in Canada could have their homes invaded by big uniformed secret police Nazis because of second hand pot smoke." The BC Marijuana Party objects to these raids and fishing expeditions on our officials and will be seeking legal remedy to this outrage. When this story broke the debate centered around the fate of those .357s. The Police and politicians wanted the guns destroyed as opposed to a trade in amount. At least that is what they were saying then. On a TV news blurb this evening, it turns out the city will be going for the trade in offer from the supplier of the new side arms. The politico spokes person, a fellow named Prescott is assuring the public that the used hand guns will not fall into the wrong hands. They will be resold to "legitimate" buyers out side of Canada. It appears that politicians who supported C-68 and wendykins have principles a mile wide and an inch deep when a few bucks are involved. This is a global drive by the UN. The US disagreed and did not sign. Its not that prime ministers and presidents are looking to kow-tow to someone who will lead them, but more that they will have influential and international support in their effort to take care of us. The fear is not exactly the UN, but the possibility of a New World Order. The UN is feared because people believe they are the most likely to become the NWO. I haven't done enough research to say "yay or nay", but I don't think it would be the UN. As things are, there is a lot of counseling that goes on whenever a substantial decision gets made by what you call "world leaders". That is to say that influential individuals are conferred with by bureaucrats, presidents, and prime ministers in order to get advice. Regardless of what you think, there are a few people that prefer to think for themselves and safeguard their freedom. That is dealing with reality! Like I said, I haven't done enough research just yet to extrapolate on very much with certainty, but refusing to swallow sugar coated pills is always a damn good step and its something everyone can do.
