Dear Sir/Madame, Mr. and Mrs. Sousa refer to themselves as pacifists. Other words spring to mind, as they deny their child the right to safety in the modern world. As firearms deniers, they create a world for their child free from care and responsibility -- kind of a nerf planet. While Mrs. Sousa argues that the "word gun is synonymous with death", and racks her brains to figure out why a seven year old might be taught about firearms and their consequences, one might only look to the lessons learned in Mississaugua just a short time ago, when a seven year old took the life of her six year old brother with an object which must remain nameless. I would try to gently persuade Mrs. Sousa that ignorance is synonynous with death. A better approach might be to have a rudimentary firearms awareness program taught in our elementary schools along the lines of don't touch!, tell an adult! leave the area! To deny the existence of firearms and to surround them with a mystical shroud of "badness" coupled with a twisted media image is to guarantee that they become kid magnets. By definition, and under the firerams act, the only firearm a child can come into contact with are those which are either illegal, and/or improperly stored. Educate, demystify and keep our kids safe. Même si le certificat de son tournevis n'a aucune utilité, même valide, c'est la seule mesure dissuasive retenue pour l'instant par le Centre canadien des armes à feu (CCAF) pour ralentir l'ardeur des farceurs qui seraient tentés d'enregistrer autre chose qu'une arme à feu. Le CCAF n'a pas l'intention de d'amener les contrevenants en cour. "Selon la loi, il est interdit de faire une déclaration futile ou erronée, souligne Chantale Breton, porte-parole du CCAF. Dans un cas comme celui de M. Dumas, nous communiquons avec le client et nous invalidons son certificat." Mme Breton indique que jusqu'à présent, aucun cas n'a nécessité d'action judiciaire. Questionnée à savoir si le CCAF gardait cette option pour décourager les gens de faire de fausses déclarations, la porte-parole refuse de répondre. Elle se borne à répéter que "le client sera contacté et le certificat sera invalidé". Vérification Comment se fait-il que personne n'ait vérifié au préalable les informations fournies par Patrice Dumas avant d'émettre le certificat d'enregistrement? "Toutes les demandes sont vérifiées, réfute Mme Breton. Nous prenons pour acquis que la demande n'est ni futile ni erronée. Avec le volume de demandes (500 000 par Internet, le moyen choisi par le Bromontois), il se peut qu'un certificat ait été émis avant que quelqu'un ne puisse vérifier les informations. Ce n'était qu'une question de temps avant que M. Dumas soit repéré." Chantale Breton précise ne pas être en mesure de dire combien de certificats ont pu être révoqués depuis le début des enregistrements, en décembre 1998. En quatre ans, six millions d'armes à feu ont été enregistrées, mais jusqu'à présent, seulement un autre cas d'enregistrement farfelu a été relevé au Canada. En mars dernier, un homme du Manitoba avait enregistré comme arme à feu son... pistolet à souder! Claude Lacasse, vice-président du Centre de tir des Loisirs de Granby, trouve troublant que le CCAF air raté quelque chose d'aussi gros. "Je veux bien concéder que les gens qui enregistrent les armes n'ont peut-être pas de grandes connaissances en armes à feu, mais quand tu marques un tournevis... Ça prouve qu'il y a un gros manque." Le député libéral de Brome-Missisquoi, Denis Paradis, estime que l'aventure de Patrice Dumas n'est qu'une "coquille du système". "Je ne remets pas en question l'utilité du programme, poursuit-il. Je crois que c'est une mesure utile pour la société sur le plan de la sécurité. Le pire, pour moi, ce sont les coûts astronomiques que ce programme a engendrés. Le système a avantage à être revu, et le ministre de la Justice Martin Cauchon nous assure qu'il est en train de faire cela." M. Paradis avouait ne pas être très au fait de la procédure d'enregistrement. "Je ne possède pas d'arme à feu, confie-t-il. Mais j'ai un coffre d'outils... Il y a un manque de vérification, à tout le moins." Autres moyens La démarche de Patrice Dumas n'est toutefois pas celle que préconise d'autres organismes opposés à la loi C-68 (Loi sur l'enregistrement des armes à feu). "Nous n'encourageons jamais des trucs comme ça, prévient Claire Joly, présidente de la section québécoise de l'Association canadienne des propriétaires d'armes à feu non enregistrées (CUFOA). Mais cela nous sert, ça montre le fouillis total de ce système. Nous ne condamnons pas les personnes qui ont fait comme M. Dumas. Ces gens se sentent intimidés et criminalisés par le gouvernement." M. Lacasse parle pour sa part d'une "démarche ridicule" qui "démontre la faiblesse du système". [emphasis mine] As far as I know, this is *not* the wording of C-10, which hasn't even passed the Senate yet; how can they have an official document that describes something that isn't even legal? What process/mechanism is used to draft such "prescribed forms"? There must be a paper trail that authroizes this document to exist in the format in which it exists. Who is responsible? Who gave the orders? How can we find out? Mr Polishchuk gave no reason for staying the charges. The obstruction charges resulted from an Liberty Demonstration in front of the Saskatoon Police Headquarters on 21January2003 when Saskatoon Police Sargent Shalovelo attempted to confiscate a “receiver”, a non-functional part of a firearm, from Dr Gingrich. Dr Hudson had just sold the receiver to Dr Gingrich in direct contravention of the Firearms Act. Dr Hudson “finds situation this baffling. We were stopped and arrested because Sargent Shalovelo wanted to investigate a crime. Now, the crown prosecutor is dropping these charges and is not laying other firearms related charges. Something is wrong in the application of justice here in Saskatoon. Either the police had a valid reason to stop us or they did not. If the crown prosecutor does not consider our action harmful to public safety, why is that action prohibited by the Firearms Act ?” To further the protection of civil liberty, Dr Hudson will lay an information charge against Dr Gingrich for transferring a firearm without “obtaining authorization of the chief firearms officer for the transfer”. “We must protect our civil liberties and freedoms from the infringements of the Firearms Act.
