Motive unknown in killing of 35-year-old; accused was serving probationary sentence - ---------------------------------------------------------------------------- Charges were laid yesterday in a fatal shooting the police believe is gang-related. Hancy Cave, 30, appeared in court briefly to learn that he faces a charge of second-degree murder in the death of 35-year-old Patrick Thomas. The victim was shot and chased through a small part of a residential section of LaSalle early Wednesday. He died on the front balcony of a home on Stinson St. Homicide investigators are still trying to determine the motive behind the slaying but they believe it is gang-related, in particular to a new street gang called the 67s. They are also attempting to sort out why Thomas was in a pedestrian tunnel, underneath the Highway 138 approach to the Mercier Bridge, when the shooting started. Thomas, of Dollard des Ormeaux, appears to have no ties to the neighbourhood where he died. But court records indicate between 1999 and 2002 Cave lived in the apartment building directly next door to the triplex where Thomas died. At the time of his arrest, Cave was serving a two-year probationary sentence. In August, he pleaded guilty to possession of a loaded .38-calibre Smith and Wesson firearm. When Thomas's body was found a blood trail led investigators to the tunnel. Cave was arrested nearby and was found to have blood on his shoes. Tests have been ordered to see whether DNA from the victim's blood matches that found on the shoes, police said. Cave's next court appearance is scheduled for July 25. pcherry@thegazette.canwest.com ------------------------------ Date: Fri, 11 Jul 2003 17:33:11 -0600 (CST) From: "Breitkreuz, Garry - Assistant 1" Subject: Raid turned up a loaded handgun PUBLICATION: The Toronto Sun DATE: 2003.07.11 EDITION: Final SECTION: News PAGE: 28 BYLINE: JONATHAN JENKINS, TORONTO SUN - ---------------------------------------------------------------------------- 7 HELD IN CRACKHOUSE RAID - ---------------------------------------------------------------------------- Neighbours applauded after Peel Region police swooped down on a Brampton crackhouse, rounding up seven people and laying nearly 60 charges. The raid on the Archdekin Dr. home by members of the North End street crime unit also turned up a loaded handgun, 15 grams of crack and assorted drug gear. Police believe the house was being used by Crip gang members from Toronto who moved west about a year ago. Officers began monitoring the house after the resultant boom in traffic in and around the home sparked a stream of complaints from neighbours. During June and July of this year, police mounted Project Blue Sweep, targeting the house and the activities there, mostly the sale of crack cocaine. At 1:30 p.m. Wednesday, the street crime unit moved in, to the delight of area residents. The handgun and drugs were seized and six adults and a youth were charged. ------------------------------ Date: Fri, 11 Jul 2003 17:33:44 -0600 (CST) From: "Breitkreuz, Garry - Assistant 1" Subject: 300 pot plants along with cash -- $20,000 -- and three handguns PUBLICATION: The Calgary Sun DATE: 2003.07.11 EDITION: Final SECTION: News PAGE: 12 - ---------------------------------------------------------------------------- DRUG OPS TOAST - ---------------------------------------------------------------------------- City police have swooped in on four illicit drug operations in just two days. Two drug warrants were executed yesterday at homes in Coventry Hills and Panorama Hills, where marijuana grow operations were uncovered. In Coventry Hills, cops also found steroids and cocaine. On Wednesday, two other grow ops were found on a quiet street in an upscale northwest community. Police raided a rental home on Edgeland Cres. N.W. and found 1,000 plants worth an estimated $800,000. While police were loading up the seized drugs, a neighbour reported similar suspicious activity at a home two doors away. Police got a search warrant and inside the second home found 300 pot plants along with cash -- $20,000 -- and three handguns. Police wouldn't speculate whether the two Edgemont matters are connected. I just wanted to point out that your headline makes it appear as if this was a paintball-related accident when it was not. Those boys could have easily been using rocks with that slingslot and that makes me wonder: If they were using rocks, would we have even seen an article at all on the front page? The article itself pointed out that people should play paintball in fields where there is staff to watch the games for safety, but it did not help parents by telling them where they could find fields to send their kids to, instead of playing in the back yards. There are currently two paintball fields with insurance with trained staff in the Essex County area, Paintball Wilderness Inc. and Diehard Paintball. Also, we do not use rifles to shoot paintballs. A legal firearm is a gun that shoots 500 feet per second or higher with a rifled barrel. Our paintball markers are chronographed at 280 feet per second for field use. We use radar chronographs to measure the speed of the equipment to keep the markers within safe operating levels. Over the past two years, there have been several articles about paintball in the Essex area. I would really hope to see the next article have the proper terminology used for paintball equipment and possibly touch a bit more on the legal fields and safety measures that they have in place. She is charged with five counts of robbery and five counts of possessing a dangerous weapon, two counts of possessing stolen property and three counts of using an imitation firearm. Cops have already charged another teenaged girl and a teenaged boy in the Co-Ed Bandits' string of armed robberies in early June. Their names can't be released under the Youth Criminal and Justice Act. The holdups were all similar -- a male and two females entered convenience stores or gas stations, brandishing either a machete or a sawed-off shotgun, demanding cash and cigarettes. And in one case, they led cops on a high-speed chase before the pursuit was abandoned. No one was hurt in any of the heists. Box - CP 1200 Miramichi, NB E1N 5Z3 Dated: 14 July, 2003 Re: Registration Certificates Dear Sir/Ms, Over the last several months we have had an ongoing correspondence regarding the registration of my various firearms. This has involved my initial submission of forms with "Unknown" marked in question fields that I am not qualified to render legally exact answers to. Following this I sent $18.00 payment as required. I have repeatedly asked your department to take one of three courses of action, namely to either (1) provide the registration certificates for my firearms, (2) send a verifier to my house to glean to your satisfaction the "Unknown" information, or (3) to refuse to provide registration certificates. In the case of (3), I requested that the responsible official respond with full identification by name and position, and with the reasons for the refusal clearly detailed. On 30 April, 2003, after numerous calls to several people, two verifiers came to my house, we entered new information based on their examinations of my firearms and I resubmitted the forms. In all correspondence I have had to write reminder letters to prompt any reply from your department. The last correspondence I received from you was dated 15 May, 2003, claiming that I had not paid the $18.00 fee. I received and responded to this letter on 27 May, explaining that the payment had been sent five months earlier. Since 01 January, 2003, I have been in technical violation of the Registration Component of the Firearms Act, in that I am in possession of numerous firearms for which I do not hold registration certificates. Currently the final pseudo-amnesty has expired as of 01 July, leaving me in the vulnerable position of being at risk of apprehension, confiscation of my personal property, and imprisonment for the "crime" of harmlessly going about my traditional lifestyle of target shooting and hunting. There is something deeply flawed with this country when honest decent folk can be treated this way by the State. It is a fundamental flaw affecting the very process by which we are governed and this whole gun registry boondoggle is merely a symptom of it. It leaves me saddened and disillusioned that my beloved Canada has declined to this point. Hopefully brighter political days lie ahead following the next federal election. I would like to conclude by saying that I have discharged my legal obligations under the Firearms Act to such extent as is humanly possible. At this point I don't see much use in having any further correspondence with the CFC regarding my registration certificates. I will not make any further attempt to obtain them. I really have no further interest or concern whether-or-not they are ever issued, because based on current news events it appears that this law will not be enforced anyway. Yours truly, M.J. "Arrest us!" they threaten. "Throw us in jail!" they yell, but five provincial legislatures and a multitude of police stations later, no one has taken the Canadian Unregistered Firearms Association up on their offer. The association, comprised of six gun-owning men, is travelling across the country in an effort to be properly charged with possession of an unregistered firearm under the Firearms Act. En route to Queen's Park in Toronto, the association hosted an informal meeting at the Regency Motel Thursday, attended by 15 anti-registration supporters, in an effort to increase awareness and build a network. Federal gun licensing came into effect Jan. 1, 2002, and as of Jan.1 all guns were required to be registered in the estimated $1 billion federal gun registry. The government then granted an additional six month grace period for all owners to abide. As of July 1, it is illegal to be in possession of an unregistered firearm, so the CUFA took to the streets to test it out. These opponents of gun registry have staged several displays of civil disobedience in hopes of having the law subject to the proper judicial tests. Declarations of their unlawfulness has been made directly to the government and police, to no avail. "Nobody has arrested us and we want to know why," said CUFA member Bruce Montague. "With such an expensive, fancy new law, you think they'd be willing to take it for a spin around the block." He added: "We think the police know it wouldn't stand up in court, and deep down, the government knows they're right." According to CUFA, the Firearms Act violates the Canadian Charter of Rights and Freedoms, specifically rights to privacy, security of person, presumption of innocence, association, representation, mobility and freedom from unreasonable search and seizure. By registering their guns, they would be complying with these personal infringements. "We've got wives, kids, families, we go to church and have normal jobs," said Montague, a gunsmith by trade. "We're just as concerned about public safety as the next person," but this law didn't change anything about safety. "The law is going to drive a wedge between the public and law enforcement," said John Gayder, an off-duty Niagara Parks Police officer who attended the meeting. "There is a marked decrease in respect for law enforcement because of the gun laws." "The piece of paper does nothing but cost a lot of money and fools the public into thinking something is being done about gun safety," added Al Muir, one of the CUFA organizers. "A lot of serious precedents are set with this law and it doesn't just affect gun owners." Muir said their plight would not stop "till we're all in jail." "I don't care what the numbers say. I will not comply, period," said Montague. "This is not up for public vote, these are my rights and liberties at stake." ------------------------------ Date: Fri, 11 Jul 2003 17:46:12 -0600 (CST) From: Edward Hudson Subject: Quebec Federal Prosecutor Friday, 27June2003 Department of Justice Federal Prosecutor’s Office 200 West Rene Leveque Montréal, Quebec H2Z 1A3 Dear Monsieur or Madam, Re: Evidence of Contravention of an Unjust Law Please find enclosed a home video recording which I made of two of our members contravening several sections of the Firearms Act and the related sections of the Criminal Code of Canada.
