John Graham was extradited from British Columbia in December, four years after he was charged with killing Aquash, a fellow AIM member from Nova Scotia, around Dec. 12, 1975, on the Pine Ridge Indian Reservation. Graham pleaded not guilty in federal court in Rapid City to first-degree murder. His trial is scheduled to start June 17 in Rapid City. Graham's lawyer, John Murphy, asked a federal judge this past week to make the government reveal the location of and make available to a defence expert for testing Aquash's underwear and a sanitary napkin taken at the first autopsy. A rancher found the unidentified body Feb. 24, 1976, north of Wanblee. The local coroner, Dr. W.O. Brown, ruled she died of exposure to the cold. Brown found evidence of acid phosphate in her vagina, from which he concluded she had sex shortly before her death, Murphy wrote in his memorandum filed with the request. Brown turned over the evidence to the FBI after the autopsy, Murphy wrote. The FBI then used an identification procedure common at the time that involved cutting off the hands, which was done and weeks later identified the body as Aquash. The remains were exhumed from an Oglala grave and a second autopsy by Minneapolis pathologist Garry Peterson revealed she had been shot in the back of the head with a .38-calibre handgun. He ruled the death a homicide. Brown, now deceased, then wrote that he "inadvertently overlooked" the bullet, although Peterson said a nurse at the first autopsy remembered seeing blood flowing from the head wound. The peculiar circumstances compounded allegations that federal agents were involved in the slaying, which they have denied. They have said AIM leaders ordered the killing. Murphy wrote in the court document that Graham notified prosecutors Feb. 7 he wanted the underpants and sanitary napkin tested and asked whether the items had ever been checked for DNA. Prosecutors have not responded, he wrote. "Mr. Graham needs to have these items preserved and tested in order to fully investigate the facts of his case. DNA testing on these items may lead to the production of material evidence that assists Mr. Graham in his defence by implicating others in the crime alleged, corroborating other witnesses' version of events that implicate uncharged third parties in this crime, and by attacking the credibility and consistency of the government's theory of prosecution," Murphy wrote. Murphy was unavailable for comment. U.S. Attorney Marty Jackley is not allowed to discuss pending court cases. Another man charged with killing Aquash, Fritz Arlo Looking Cloud, was convicted in 2004 and given a mandatory life prison sentence. He is from Pine Ridge but had been living homeless in Denver. In an earlier court filing, Murphy asked the judge to require prosecutors to turn over all of Looking Cloud's statements, some of which were made under the influence of drugs and alcohol, so Graham can spot inconsistencies. "The government's only alleged witness to the crime, Mr. Looking Cloud, is an accomplice who has been sentenced to life and who has a motive to fabricate," he wrote. At Looking Cloud's trial, witnesses said he, Graham and another AIM member, Theda Clark, drove Aquash from Denver and that Graham shot Aquash in the Badlands as she begged for her life. Clark has not been charged. She lives in a nursing home in western Nebraska and has refused to talk about the case. (AP) - Steven Kazmierczak checked into a hotel near Northern Illinois University three days before his deadly shooting spree at the campus, paying cash and signing in under only his first name, the hotel manager said Saturday. Kazmierczak was last seen at the Travelodge on Tuesday, hotel manager Jay Patel said. Cigarette butts, empty energy drink and cold medicine containers littered the room Friday. Authorities found a duffel bag, with the zippers glued shut, that Kazmierczak had left in the room, DeKalb police Lt. Gary Spangler said. A bomb squad safely opened the bag Friday, he said. The Chicago Tribune reported Saturday that investigators found ammunition inside the bag, citing law enforcement sources. Spangler would not comment on what was in the bag. Kazmierczak also left a laptop computer, which was seized by investigators, Patel told The Associated Press. "It's scary," said Patel, adding that he called police when he found the laptop and clothes. The discoveries added to the puzzles surrounding Kazmierczak, a 27- year-old graduate student some called quiet, dependable and fun- loving. He returned to his alma mater on Valentine's Day and killed five people before turning a gun on himself. A former employee at a Chicago psychiatric treatment center said Kazmierczak's parents placed him there after high school. She said he used to cut himself, and had resisted taking his medications. He had a short-lived stint as a prison guard that ended abruptly when he didn't show up for work. He also was in the Army for about six months in 2001-02, but he told a friend he'd gotten a psychological discharge. Exactly what set Kazmierczak off-and why he picked his former university and that particular lecture hall-remained a mystery. On Thursday, Kazmierczak, armed with three handguns and a pump-action shotgun, stepped from behind a screen on the lecture hall's stage and opened fire on a geology class. He killed five students before committing suicide. University Police Chief Donald Grady said Friday that Kazmierczak had become erratic in the past two weeks after he stopped taking his medication. Kazmierczak spent more than a year at the Thresholds-Mary Hill House in the late 1990s, former house manager Louise Gbadamashi told The Associated Press. His parents placed him there after high school because he had become unruly, she said. Gbadamashi said she couldn't remember any instances of him being violent. "He never wanted to identify with being mentally ill," she said. "That was part of the problem." The attack was baffling to many who knew him. "Steve was the most gentle, quiet guy in the world. ... He had a passion for helping people," said Jim Thomas, an emeritus professor of sociology and criminology at Northern Illinois who taught Kazmierczak, promoted him to a teacher's aide and became his friend. Kazmierczak once told Thomas about getting a discharge from the Army. "It was no major deal, a kind of incompatibility discharge-for a state of mind, not for any behavior," Thomas said. "He was concerned that that on his record might be a stigma." Kazmierczak enlisted in September 2001, but was discharged in February 2002 for an unspecified reason, Army spokesman Paul Boyce said. He worked from Sept. 24 to Oct. 9 as a corrections officer at the Rockville Correctional Facility, a medium-security prison in Rockville, Ind. His tenure there ended when "he just didn't show up one day," Indiana prisons spokesman Doug Garrison said. On Friday, investigators interviewed Kazmierczak's father in Lakeland, Fla., and his former girlfriend in Champaign, the Chicago Tribune reported. Investigators provided no details about what they may have learned. Authorities were looking into whether Kazmierczak and the woman recently broke up, according to a law enforcement official who spoke to the AP on condition of anonymity because the case is still under investigation. On Feb. 9, Kazmierczak walked into a Champaign gun store and picked up two guns-a Remington shotgun and a Glock 9mm handgun. He bought the two other handguns at the same shop-a Hi-Point .380 on Dec. 30 and a Sig Sauer on Aug. 6. All four guns were bought legally from a federally licensed firearms dealer, said Thomas Ahern, a spokesman for the federal Bureau of Alcohol, Tobacco, Firearms and Explosives. At least one criminal background check was performed-Kazmierczak had no criminal record. Kazmierczak had a State Police-issued FOID, or firearms owners identification card, which is required in Illinois to own a gun, authorities said. Such cards are rarely issued to those with recent mental health problems. NIU President John Peters said Kazmierczak compiled "a very good academic record, no record of trouble" at the 25,000-student campus in DeKalb. He won at least two awards and served as an officer in two student groups dedicated to promoting understanding of the criminal justice system. Kazmierczak (pronounced kaz-MUR-chek) grew up in the Chicago suburb of Elk Grove Village. He was a B student at Elk Grove High School, where school district spokeswoman Venetia Miles said he was active in band and took Japanese before graduating in 1998. He was also in the chess club. No one answered the door Saturday morning at the Urbana home of Kazmierczak's sister, Susan. But sobs could be heard through the door, where a posted statement said: "We are both shocked and saddened. In addition to the loss of innocent lives, Steven was a member of our family. We are grieving his loss as well as the loss of life resulting from his actions." At NIU, six white crosses were placed on a snow-covered hill around the center of campus, which was closed Friday. They included the names of four victims-Daniel Parmenter, Ryanne Mace, Julianna Gehant, Catalina Garcia. The two other crosses were blank, though officials have identified Kazmierczak's final victim as Gayle Dubowski. By Friday night, dozens of candles flickered in packed snow at makeshift memorials around campus as hundreds of students, mostly wearing the school colors of red and black, packed a memorial service. "It's kind of overwhelming. Stephen Kazmierczak, 27, played the wildly popular game Counter-Strike while studying sociology at Northern Illinois University in 2003 and 2004. "He played a lot of video games, especially Counter-Strike, really loud," said dorm mate Ben Woloszyn, 24. In the game, players use imaginary money to buy shotguns, pistols and other equipment they need to move around an imaginary world in which they're constantly under threat of being killed by roving terrorists. In real life, Kazmierczak - who had become "erratic" recently after shunning medication for an undisclosed illness - purchased weapons like those used in Counter-Strike, including a Glock handgun and a pump-action Remington shotgun, which he bought legally on Feb. 9. He had two other pistols that cops said were also bought legally, though they weren't sure when. Police wouldn't say why Kazmierczak stopped taking his medication, or what is was for. Though a loner, Kazmierczak wasn't antisocial, said acquaintances. He had been an officer in the campus chapter of the American Correctional Association. He worked briefly as a full-time correction officer at the Rockville Correctional Facility, a medium-security prison in Indiana, but his tenure there lasted only from Sept. 24 to Oct. 9, after which Indiana prisons spokesman Doug Garrison said "he just didn't show up one day." Kazmierczak also had a short-lived stint in the Army. He enlisted in the Army in September 2001, but was discharged in February 2002 for an "unspecified" reason, said an Army spokesman. He got his undergraduate degree in 2006, and was enrolled in Northern Illinois' graduate school last spring. At around 3 p.m. Thursday, Kazmierczak shot up a class containing between 70 and 100 students before killing himself. "He had a blank look on his face. The group, which at one time stated on its Canadian website that it was no more, now has a new site saying, "Big changes coming soon ... Stay tuned." The message is signed off by the letters NSCC, an acronym for the No Surrender Crew Canada, a nickname used by the Canadian wing of the Texas-based one-percent motorcycle club. The former Toronto leader of the club, Francesco "Cisco" Lenti announced on the site last October "There isn't no more Bandidos MC membership in Canada." The statement followed Lenti's arrest for second-degree murder. He's awaiting trial in the December 2006 shooting murder of Toronto West Hells Angels sergeant-at-arms David (White Dread) Buchanan and the wounding of two other Hells members. Buchanan was reputedly a supplier of firearms to street gangs in Rexdale. The Bandidos was also left shattered when eight of its Toronto area members, including its Canadian leadership, were found dead, their bodies stuffed into vehicles, in Shedden, near London, in April 2006. Trial is expected to start next fall for eight people charged with first-degree murder in the deaths. "They want the word to get out about their re-opening," said an associate who spoke on condition of anonymity. "They don't want any misconceptions because of what was listed on the site ... "They did close down for a short period of time," he said. "It's been (nearly two) years since ... Shedden. What they've gone through, and the odds that they were up against, basically shook the club apart," the associate said. "A lot of the strongest members of the No Surrender Crew have come back together. They are just not willing to give it up and they've re-opened the Bandidos back up in Canada again," he said. A police source who is familiar with the Bandidos said "the guys in Winnipeg have been down to try and get things re-established" in Ontario. "The Winnipeg guys have ties to the States," he said, indicating the move may have the approval of the Bandidos' hierarchy in Texas. The source said what may be behind the move back into the province is the weakened state of the Hells Angels, who were given blows by police in two undercover projects where the Biker Enforcement Unit convinced two Angels to turn on the gang. "You got Ontario chapters of the HA weakened ... you got this other trial going on where you have a bunch of people charged with killing (the Shedden victims)," the officer said. "So you have that bad publicity coming out of that, that they don't exist anymore, so they want to prove to people that they do. But you know what? His death marks the city's sixth homicide of the year. McGuinness said the man was known to police, but would give few other details, saying police are still investigating. But witnesses at the scene said they saw about six bullet holes on the driver's side of the van, and a screaming woman cradling the dead man in her lap. "A woman was holding the body and crying and screaming 'No, this can't be happening,'" said photographer Lili Yakub, who arrived minutes after the shooting. The area was clogged with onlookers before police blocked off Carrall at Hastings. The body, wrapped in a sheet, was still lying on the sidewalk about three hours later. The street was expected to be closed for several hours tonight, McGuinness said, as forensics officers combed the area for clues. She said several witnesses were also being interviewed. A few blocks away, police also cordoned off Cambie between Cordova and Hastings and posted police guards at the gated entrance of a Mexican restaurant at the northwest corner of the Dominion Building. One boy was arrested Wednesday night after boarding a Toronto transit bus and two others were arrested Thursday. The three boys — two aged 15, the other 14 — are all facing several charges, including counts of robbery while armed with firearm and disguise with intent. Michael Seifert, 83, boarded a commercial flight bound for Italy at Pearson International Airport in Toronto at 3 p.m. Friday, confirmed Alain Cherette, a spokesman for Canada's Department of Justice. "Mr. Seifert was flown to Toronto and from there, he was handed over to Italian authorities," Cherette said. Seifert faces a life sentence in Italy where, seven years ago in an Italian military court, he was convicted in absentia for war crimes committed during his time as an SS guard in the Second World War. The crimes took place in a Nazi prison camp at Bolzano, Italy, in 1944 and 1945. Nicknamed the "Beast of Bolzano," Seifert has always denied involvement in the atrocities. He was found guilty in the Italian trial of being involved with nine killings and abuses at the police transit camp that imprisoned Jews, Italian resistance fighters and others, some of whom ended up being taken to Nazi concentration camps. While working as a guard, Seifert was responsible for supervising prisoner work and performing prisoner roll calls. He also took prisoners to trains destined for Nazi death camps. He had left Ukraine at the start of the war. In his defence, Seifert has said he was at the camp only because he was serving a sentence there for a sexual assault involving another Ukrainian guard. Seifert had been living in east Vancouver since arriving in Canada in 1951. Italy made an extradition request for the former Ukrainian national in May 2002, and Seifert spent the past six years fighting Ottawa's efforts to extradite him. Last month, the Supreme Court of Canada refused to hear Seifert's appeal of last year's Federal Court ruling that since Seifert lied about his birthplace and his former occupation when he was applying for Canadian citizenship, it can be revoked. Seifert argued he lied to Canadian immigration authorities only because he would be killed if his former native Ukraine found out he was emigrating. "He was at the end of his options," Cherette said. "That cleared the way for his extradition. It's the end of due process. He's used every legal tool that was at his disposal and that was it." Seifert had been held in custody in a Vancouver-area prison until he was removed Thursday by RCMP officers who escorted him to Toronto, Cherette said. Seifert was handed over to two Italian officers from Interpol at the Toronto airport Friday prior to boarding his afternoon flight. Cherette said it is now up to Italian authorities to decide what to do with him. Italian news agency Agenzia Giornalistica Italia reported Friday that Seifert will be transferred to a military hospital in Verona, the capital of the province where his war crimes took place. Bernie Farber, head of the Canadian Jewish Congress, said Seifert's extradition sends a clear message the Canadian government is taking a hard stance on Nazi-era defendants. "This is excellent news. It's been a long time coming," he said. "Sadly, other governments had turned a blind eye to the murderers around us. Hopefully this signals a change in attitude in Canada." Farber said Holocaust survivors living in Canada can finally feel some kind of justice. "It brings great solace and great comfort to Holocaust survivors who came here and discovered sadly that they were sharing their new-found land with their victimizers. It's been a terrible time for them," Farber said.
