After a relentless cross-examination of tactical leader Const. Matthew Kohler, prosecutor Anthony Leitch told Justice Irving Andre that he saw no prospect of a conviction. He requested the charges be dismissed and Justice Andre granted his request In doing so, Leitch praised Kohler for answering all of his tough questions, telling the court he had left "no stone unturned" but the officer never wavered from his belief that he and his fellow tactical officers did nothing wrong in subduing Gerry Morgan, 79, in the early hours of Nov. 25, 2006. Family members left the court without commenting on the stunning development that occurred moments after Kohler, the defence first witness, finished his day-long testimony. Kohler told the Oakville court that he was prepared to shoot and kill the knife-wielding man, if necessary. Armed with a sub machine gun, Kohler said he would have fired at Morgan, a man who was suffering from Parkinson's Disease, had he "advanced" on him or his officers. Fortunately, Morgan, 79, was subdued by a Taser after a rubber bullet failed to cause the Oakville man to drop the butcher knives he was holding and swinging in both hands. Some comments; citizens have their say: Use your shield... Tactical squads carry large bulletproof shields. Surely Mr. Morgan should have been pushed into a corner and neutralized with a shield. If so, they should be removed from duty for being physically unfit. It's actions like this one that make people lose all trust in law enforcement forces. There were 3 or 4 cops there and that is what he would turn to? My father had dementia from Parkinson's disease, a 6 year old could have disarmed him. Canada has become worse then Mexico and our police are very much so above the law. They certainly don't instill confidence in me that they can protect us. Also remember, if it had been a deer or a moose, they would have used a tranquilizer instead. [Recently during the Vancouver taser incident it was reported that 'taserd' were 'unauthorized weapons' under the CCC. The shuffle of a campaign might well deliver them the same lacklustre hand, give or take a few cards. The common death wish of the Conservatives, the Liberals, the NDP and the Bloc Québécois for the beleaguered 39th Parliament amounts to a vote of non-confidence in their respective strategies. At this rate, they all fear they may be in worse shape six to 12 months from now. The record longevity of their minority government settles the issue of whether the Conservatives were fit to govern. But the larger question is whether voters are satisfied with what they have done with their trial run in government and, if so, whether they want more of the same. Over the past 2 1/2 years, Prime Minister Stephen Harper has taken Canada in directions that were, more often than not, made possible by the Liberal fear of an election rather than by a parliamentary consensus. In the next election, Harper will be asking Canadians to vindicate the many policies that failed to garner majority support in the Commons. The results will tell whether he has taken too many liberties with his minority mandate. A second minority combined with a Conservative failure to expand in urban territory would amount to less than a popular vote of confidence. A fall election will also be an occasion to judge Liberal efforts at renewal. Only one in three Canadians and barely one in five Quebecers supported the Liberals in 2006. The United States attorney’s office in Denver has scheduled a news conference for Tuesday afternoon to discuss its investigation. A spokeswoman for the Denver Police Department said that an “aggressive” inquiry had been under way since the first arrest in the case. That occurred during a traffic stop in Aurora, Colo., on Sunday morning, when the police seized firearms and methamphetamine, the authorities said. It was not clear how well along the possible plot was, or whether the people under arrest had found a way to overcome the heavy security surrounding the Democratic convention. Mr. Obama is scheduled to deliver his speech at Invesco Field, near the convention center. The United States attorney for Colorado, Troy Eid, seemed to play down the degree of threat that Mr. Obama faced. “Because this matter is currently under investigation, there is little we can say right now,” Mr. Eid said in a statement. “We can say this: We’re absolutely confident there is no credible threat to the candidate, the Democratic National Convention, or the people of Colorado.” The police said they had found two rifles, one with a scope, in the car, along with walkie-talkies, a bulletproof vest and licenses in the names of other people. One of the rifles was listed as stolen from Kansas. The investigation included the Secret Service, the F.B.I. and a joint terrorism task force, officials said. Linda Douglass, a senior adviser to the campaign, declined to comment late Monday on reports of the investigation. It is the campaign’s practice not to comment on such reports, which have occurred periodically through the campaign. Detective Marcus Dudley Jr. of the Aurora Police Department, said the first arrest involved Tharin Robert Gartrell, 28, who was taken into custody after the police pulled him over for driving erratically in a rental truck early Sunday morning. The others arrested were identified as Nathan Johnson, 32, who was picked up a few hours later by the Denver police at a hotel. The third arrest took place about half hour later. The suspect was identified as Shawn Robert Adolf, 33, who was arrested in Glendale, near Denver, shortly after leaping from a sixth-floor hotel window, the authorities said.
