Toronto Police say residents of Meadowbank Rd., near Burnhamthorpe Rd. and The East Mall, heard gunshots ring out around 4 a.m. “Officers responded and found a man suffering from multiple gunshot wounds to his body,” Const. Tony Vella said. The victim, who was wearing pyjamas and no shoes, was pronounced dead at the scene. His body lay on the ground for hours as officers gathered evidence. The Coroner finally picked up the body around 11:30 a.m. “It’s not something you see every day in this neighbourhood,” area resident Steve Chamyk said, staring down the street from outside the crime scene tape at the orange sheet covering the victim. Chamyk, who didn’t hear the shooting, said he and his wife have lived in the quiet suburban community for three years. Many old homes in the area have been replaced with new massive houses, some valued at more than $2 million, he said. Police have identified the victim, who may not have resided in the neighbourhood, but they would not immediately release the dead man’s name. The city has been plagued by gun violence since the high profile shooting at the Eaton Centre on June 2 where two men were executed and five other people wounded by stray bullets. However, the latest murder is only the city’s 26th of the year, about the same as this time last year. And by the end of 2011 there were just 50 homicides, a 25-year low for Toronto. Of this year’s slayings, 15 have been by gunfire, again about the same as this time in 2011. But shootings are up sharply. This year 164 people have been shot compared to 120 at this time in 2011. Officers canvassed residents of Meadowbank Rd. Thursday looking for anyone who may have seen or heard the deadly incident. Homicide Det.-Sgt. Pauline Gray urged any witnesses to the killing who have not yet spoken to be police to come forward. Brian Knight was convicted of criminal negligence causing bodily harm for hitting a man with light birdshot in March 2009. The man was trying to steal an all-terrain vehicle from Knight's property near Tees. According to his lawyer, Knight, 41, was defending his property when he followed Harold Groening and shot him from behind with a 12-gauge shotgun containing light bird buckshot, the Calgary Herald reported. Accounts of what happened that night say Mr. Groening took off on the ATV and was followed by Knight, who ended up hitting the ATV with his car when it swerved in front of him. When Groening took off on foot, Knight fired a shot. When that still didn't stop the would-be thief, Knight fired again. Groening was not seriously injured. Last October, Knight was sentenced to 90 days in jail to be served on weekends. In April of 2010, Groening was sentenced to 30 days after pleading guilty to one count of theft under $5,000. But the Alberta Court of Appeal has ruled that Knight's punishment was unfit and has instead given him a suspended sentence. He must complete 50 hours of community service and will be on probation for three months. The landmark ruling in an Oshawa courthouse Friday centred on the case of 21-year-old cocaine dealer Christopher Lewis, who faced the mandatory three-year sentence after offering to sell an undercover policeman a .45 caliber handgun - despite having no access to the gun nor any intention to carry through on the sale. His lawyer, Jeffrey Mazin, challenged the constitutionality of the sentence, calling it "cruel and unusual punishment." While Justice Paul Bellefontaine did not agree the prison term was grossly disproportionate for Lewis, who has racked up numerous convictions over the years, he deemed the law in a broader sense to be fundamentally unconstitutional. "Parliament has imposed a minimum penalty that addresses a worst case offence but which grossly overpenalizes the many lesser ways that the same crime can be committed," Judge Bellefontaine wrote in his 20-page ruling. "The minimum three-year sentence does not address the different degrees of moral blameworthiness associated with the different circumstances under which the offence can be committed." In addition to dropping Lewis's sentence on the firearms offence to one year, Judge Bellefontaine declared section 99 (2) (a) of the Criminal Code - which sets out a three-year minimum sentence for first-offence firearms trafficking - to be "invalid and of no force and effect." This is the second recent setback for the federal government's 2008 Tackling Violent Crime Act, which strengthened bail provisions and increased mandatory prison sentences for serious firearms offences. In February, a Superior Court judge struck down another amended section of the Criminal Code that mandated a three-year minimum sentence for a first-offence loaded firearm possession conviction. The Crown is appealing that decision. In the Lewis case, the Crown had recommended an eight-year sentence, with three years for the firearms charge and five years for associated cocaine trafficking charges. Lewis had dangled the prospect of a gun sale in front of an undercover officer to keep him interested in his services as a cocaine dealer, the court heard - even though Lewis had no intention of delivering the promised firearm. The defence had asked for a total sentence of two years. On Friday Judge Bellefontaine imposed three years, including one for the firearms offence. Wearing a white T-shirt and glasses and with his black hair styled in a short mohawk, Lewis stood in the prisoner's box for the duration of the judge's ruling and nodded his head repeatedly toward the end. In a blog post published on July 3, Timothy Johnson of Media Matters describes the notion that the United Nations would ever try to take away the right of Americans to keep and bear arms "laughable." Johnson goes on to promote the passage of the UN's Arms Trade Treaty (ATT) as a means of "curtailing the illicit arms trade" and thus cracking down on those who use these weapons to deny others their "human rights." The blog post assures citizens concerned about the potential eradication of the rights guaranteed in the Second Amendment to the Constitution that they have nothing to fear from the UN's gun control treaty. Top officials from the United Nations, the United States, and other high profile supporters have repeatedly and clearly said that the treaty does not aim to restrict anyone's "freedom to own" a gun. Indeed, the UN General Assembly's resolution on the treaty makes clear that countries will "exclusively" maintain the right within their borders to "regulate internal transfers of arms and national ownership, including through national constitutional protections on private ownerships." Constitutionalists will instantly notice a couple of red flags raised by Media Matters' word choice. First, there need be no quotation marks around the phrase freedom to own a gun. Americans should enjoy the unqualified right to bear arms and it is not some antiquated idea or some unicorn-like mythical creature that requires special punctuational treatment. Americans are well aware that an unarmed citizenry is easier to subdue and will rightly resist all efforts to abridge that right. Second, the citizens of the United States do not need the permission of the United Nations to maintain the "exclusive" right to own a gun. This right, as with all others protected by the Constitution and the Bill of Rights, comes from God, not man, and may be neither given nor taken away by any government. Undaunted, however, Soros will continue to use his mouthpieces to promote the globalist agenda, including the incremental dismantling of the U.S. Constitution and the sovereignty it protects. The current draft of the ATT mandates that the governments of member states petition the United Nations for approval of any contract to sell weapons to any nation where there exists a "substantial risk of a serious violation" of human rights. While the end of reducing the abuse of human rights is laudable, the means to achieve that cannot lawfully include the requirement that the Congress of the United States ask for permission from the UN overlords before it passes a law, including one authorizing the sale of arms to another country. That is a direct assault on American legislative sovereignty, and an indirect attack on the sovereignty of the American people who elect the members of Congress who vote on such measures. In the text of the ATT, the United Nations specifically calls for the passage of a legally binding instrument that will impose international standards for the ownership, trade, and transfer of weapons. In another section the ATT includes "controls on a comprehensive list of weaponry, including small arms and light weapons." Predictably, all these controls are couched comfortably in talk of "human rights" and ending senseless killings by rogue regimes. In order to avoid being labeled a "human rights abuser," the United States (along with all member states) is ordered by the UN to comply with the ATT. To compel this compliance, the ATT empowers the UN to force Congress to: . Enact internationally agreed licensing requirements for Americans . Confiscate and destroy unauthorized firearms of Americans while allowing the U.S. government to keep theirs . Ban the trade, sale, and private ownership of semi-automatic guns . Create and mandate an international registry to organize an encompassing gun confiscation in America On this point, in 2011, the UN's General Assembly declared "that disarmament, arms control and non-proliferation are essential." In other words, if world peace, the protection of human rights, and the disarming of violent regimes could be achieved through the confiscation of personal firearms, then so be it. Make no mistake, however, Soros and his fellow globalist gun controllers don't have in mind (at least at first) to march blue-helmeted UN soldiers into the homes of Americans with orders to seize their guns and ammunition. Rather, through the passage of binding international treaties and UN resolutions, they will force the national governments of the world to do the dirty work for them. Sadly, officials of our own federal government, including President Obama, are pushing Congress to sign off on this treaty. Secretary of State Hillary Clinton has announced that the Obama administration is working with the UN to lean on Congress to consent to the ATT. Clinton has pushed the treaty as an "opportunity to promote the same high standards for the entire international community that the United States and other responsible arms exporters already have in place to ensure that weaponry is transferred for legitimate purposes." There is little doubt that the scope of those "legitimate purposes" will be determined by Soros, Clinton, Obama, and the rest of the globalist gang who have much to fear from an armed and educated citizenry. For now, the resistance to ratification of such a treaty is strong in the United States. Last July Senator Jerry Moran (R-Kan.) and 44 other senators sent a letter to President Obama and Secretary Clinton encouraging them to stop pushing for passage of UN gun control treaties. In the letter, Moran wrote: Our country's sovereignty and the Second Amendment rights of American citizens must not be infringed upon by the United Nations. Today, the Senate sends a powerful message to the Obama Administration: an Arms Trade Treaty that does not protect ownership of civilian firearms will fail in the Senate. Our firearm freedoms are not negotiable. George Soros, through his Media Matters outlet, promises that "U.S. gun owners have nothing to fear" from the ATT or from similar UN agreements to restrict the manufacture, transfer, and possession of firearms. The globalists' only goal, they maintain, is "the maintenance of international peace and security." The only time "our elected representatives" overrule the bureaucrats is if there are major brownie points involved that win them campaign funds or votes. All the truthful and verifiable statistics indicate that firearms are the ultimate tool for self defense, yet the politicians and bureaucrats keep nattering on about the privilege of sporting use rather than the right to the only workable tool to preserve life. There is no indication given that any harm was done, either by the drugs OR the gun. At the very most Mr. Lewis was walking the edge of fraud. If he didn't take any money for the gun then even fraud would likely not stand, since no one was injured financially by the offer. If anyone is guilty of an offense here it is the undercover cop. The reason I say this is that the only harmful activity in this transaction seems to have been perpetrated by the LEO, enforcing crimes of a moral or arbitrary nature where no violence or fraud was being committed. It is evident that any of our governments, whether Conservative, Liberal or potentially NDP or Greens have no moral authority, since paper crimes, or in this case a perceived paper crime, are pursued and prosecuted. The UN arms small arms treaty and indeed Canada's gun laws are far more dangerous than anything Mr. Lewis was involved in.
