While guns on the streets of Halifax are nothing new, replica firearms are quickly turning to be a weapon of choice for many, something that's causing concern for police. "They look, they feel, they have the same weight as a true firearm, and our officers when they respond to a call in real time have to assume that what they're dealing with is a real gun" said Detective Constable Michael Cheeseman, a member of the Halifax Regional Police, RCMP Integrated Guns and Gangs Unit. The unit works to get guns off the streets of Halifax. In the past two years, police have noticed a growing trend in the use of replica firearms. Some shoot pellets, BBs or even blank rounds. "We're seeing individuals on the street carrying them for intimidating purposes, to use them in a criminal act. In my mind there's no legitimate reason to have them and it may be a situation where if they can't get their hands on an authentic hand gun, these ones look so much similar to the real ones so that's why they're reverting to them" said Cheeseman. "If you just have them in your house it's not illegal, it's what you do with them that's the issue" added Constable Jody Allison, also a member of the Guns and Gangs Unit. In 2011 and 2012 nearly 700 real weapons were seized each year. So far this year, officers have seized 262 guns, plus more than 50 fake firearms in the past year. The replica guns can be bought within the city but are also coming from across North America and around the world. Police worry that if someone uses a replica gun to intimidate, it could quickly escalate into violence, and because the fake guns look so close to the real thing, police are worried that if someone points one at an officer - it could turn deadly. Just a reminder, Section 98 of the Criminal Code of Canada allows for a life sentence for those folks who break and enter in order to steal firearms. It has never been used, and has (most likely) been plea bargained away for guilty charges on lesser offences. Bottom line charges laid that are bargained away are a sign of a corrupt legal system. Justice is NOT NEGOTIABLE. The other issue is that Section 98 of the criminal code is anti gun in that it singles out break and enter - to steal a gun- as somehow worse than break and enter to steal any other property, or to commit a violent assault. Guns are not special, nor do they have special powers. The simple act of breaking and entering for any illegal purpose should carry a life sentence to give judges latitude and leeway to decide. Supreme Court has found a teacher not guilty of conduct unbecoming after he fired his rifle over the heads of two his sons, who had assaulted him. The incident involving Michael William Fountain happened nearly 12 years ago and the case has been winding its way through the B.C. College of Teachers and the courts ever since. In August 2001, two of Fountain's sons had a confrontation with his wife, who was holding the couple's five-month-old son in her arms. Fountain, who was living on a farm near Burns Lake at the time, ordered the sons, then 17 and 20 years old, to leave the family home, but was assaulted by the two young men. His wife arrived on the scene and handed him a rifle, which he fired upwards at a 45-degree angle. Court heard that given the trajectory of the bullet, there was no actual danger to his sons or others in the rural area. Fountain said that his intention in firing the weapon was to communicate a message to his sons to leave the property, likening it to scaring off rogue bears. Fountain, who got his teacher's certificate in 1988 and had taught in Granisle, Prince Rupert and Burns Lake, was convicted in Provincial Court in December 2002 of careless use of a firearm. But in April 2004, the B.C. Supreme Court overturned the conviction, finding that the lower court had failed to consider all of the circumstances, including that Fountain was sore from his injuries and vulnerable. A panel of the college meanwhile had cited Fountain, finding that a reasonable teacher would not have communicated with a gunshot in the circumstances. The panel concluded he was guilty of conduct unbecoming and issued a reprimand against him. Fountain appealed that ruling to the B.C. Supreme Court, which ordered that the matter be sent back to the college for reconsideration. In December 2009,the college reaffirmed its finding, but Fountain appealed again. In a ruling released earlier this week, B.C. Supreme Court Madam Justice Miriam Maisonville overturned the college's ruling, finding that there was too little difference between the panel's new reasons and the old to reflect a proper reconsideration of the circumstances. "Given the amount of time that has passed in this matter, I am directing that the verdict of the panel be set aside and that a verdict of not guilty be substituted in favour," she said. "I would also direct that the reprimand be removed from the appellant's record." Court heard that Fountain withdrew from teaching for a lengthy period following the 2001 incident. In a horrific accident Tuesday that shocked a rural area far removed from the U.S. debate over gun control, her son, Kristian, had fatally shot his 2-year-old sister, Caroline, in the chest, authorities said. Kristian's rifle was kept in a corner of the mobile home, and the family didn't realize a bullet had been left in it, Cumberland County Coroner Gary White said. "Down in Kentucky where we're from, you know, guns are passed down from generation to generation," White said. "You start at a young age with guns for hunting and everything." What is more unusual than a child having a gun, he said, is "that a kid would get shot with it." In this case, the rifle was made by a company that sells guns specifically for children - "My first rifle" is the slogan - in colours ranging from plain brown to hot pink to orange to royal blue to multi-colour swirls. "It's a normal way of life, and it's not just rural Kentucky, it's rural America - hunting and shooting and sport fishing. It starts at an early age," said Cumberland County Judge Executive John Phelps. "There's probably not a household in this county that doesn't have a gun." In Cumberland County, as elsewhere in Kentucky, local newspapers feature photos of children proudly displaying their kills, including turkey and deer. Phelps, who is much like a mayor in these parts, said it had been four or five years since there had been a shooting death in the county, which lies along the Cumberland River near the Tennessee state line. Phelps said he knew the family well. He said the father, Chris Sparks, works as a logger at a mill and also shoes horses. The family lives in a grey mobile home on a long, winding road, surrounded by rolling hills and farmland that's been in the family since the 1930s. Toys, including a small truck and a basketball goal, were on the front porch, but no one was home Wednesday. There's a house across the street, but the next closest neighbour lives over a hill. Family friend Logan Wells said he received a frantic call telling him that the little girl was in an accident and to come quickly. When he got to the hospital, Caroline was already dead. "She passed just when I got there," Wells said. White said the shooting had been ruled accidental, though a police spokesman said it was unclear whether any charges will be filed. "I think it's too early to say whether there will or won't be," Trooper Billy Gregory said. White said the boy received the .22-calibre rifle as a gift, but it wasn't clear who gave him the gun, which is known as a Crickett. "It's a little rifle for a kid. ... The little boy's used to shooting the little gun," White said. The company that makes the rifle, Pennsylvania-based Keystone Sporting Arms, has a "Kids Corner" on its website with pictures of young boys and girls at shooting ranges and on bird and deer hunts. It says the company produced 60,000 Crickett and Chipmunk rifles for kids in 2008. The smaller rifles are sold with a mount to use at a shooting range. Keystone also makes guns for adults, but most of its products are geared toward children, including books and bright orange vests and hats. "The goal of KSA is to instil gun safety in the minds of youth shooters and encourage them to gain the knowledge and respect that hunting and shooting activities require and deserve," the website said. No one at the company answered the phone Wednesday. According to the website, company founders Bill McNeal and his son Steve McNeal decided to make guns for young shooters in the mid-1990s and opened Keystone in 1996 with just four employees, producing 4,000 rifles that year. It now employs about 70 people. It also has a long list of testimonials from parents who talk about how grateful they are to be able to go shooting with their children. Sharon Rengers, a longtime child advocate at Kosair Children's Hospital in Louisville, said making and marketing weapons specifically for children was "mind-boggling." When they were being sold, BD38s cost about $3,000 each. The cost of expropriating the weapons, paid as compensation to owners, was estimated at $230,000 but has since risen to $260,000. Global News's copy of the firearms database shows 74 BD38s and six BD3008s owned in Canada. Sixty-eight of the firearms have been seized, RCMP Sgt. Julie Gagnon told Global News in an e-mail this week. "The rest are in progress, with follow-up as appropriate". Sixty-one owners have been compensated, at up to $3,500 each.
