Police aren't just delayed in responding to rural calls for assistance. It happens everywhere. They are often immediately dispatched but due to manning, dispatch prioritizing and distances ARRIVE long after the crime has been committed. Police are very good generally at apprehending criminals. In the moment that crime is being committed there is no-one better positioned to stop the crime than the intended victim or a private person in the immediate area. Calling for assistance isn't always an option. Sometimes there is no cell phone coverage, such as where I live, a means to communicate to emergency services is not available OR the immediacy of the perilous circumstances means action must be taken in the moment to preserve one's safety. At 2:13 of the video the reporter propagates a complete LIE if that is what he was told. He states that the Prosecutor and the RCMP say that landowners can't defend themselves or their property; that this is a specific case. If they said that, they are entirely wrong: Criminal Code of Canada section 35(1) Clearly states the opposite with respect to defence of property, and CCC s 34(1) Defence of persons, and most authority of all, CCC s. 494(1) Arrest without warrant - by Private Person pursuant to CCC s. 25 Use as much force as necessary. So, either the RCMP or the Crown Prosecutor don't know these fundamentals of law, or they lied, or Chris Epp the CTV reporter lied. But somebody isn't telling the truth. This may be another example of the police, crown, and media trying to send the false message to the public that they don't have the authority to defend themselves and their property with force, including lethal force. The Constitutional or Charter violations and issues here are serious and why I include a larger excerpt of the article, then some of my analysis following. -------------------------------------------------------------------------- - Canada's impaired driving laws just got a huge and controversial overhaul — here's what you should know OTTAWA — A sweeping overhaul of Canada’s impaired driving laws was given Royal Assent on Thursday, meaning the new rules are starting to come into effect and drivers should be prepared. Bill C-46 made reforms to both alcohol-impaired driving and drug-impaired driving, and police now have powerful new tools to detect and charge drivers. The bill also made many technical changes to help the courts deal with impaired driving cases more quickly. There are three big — and controversial — changes Canadians will need to know about. Random roadside breath testing Starting in December (180 days after Royal Assent), police can require a roadside breath test for any driver. The crucial change is they will no longer need reasonable suspicion the person has been drinking. Drivers who refuse this test face a criminal charge with similar penalties to an impaired driving conviction. This provoked heated debate during the Senate’s study of Bill C-46, as lawyers and civil liberties groups argued it violated the Charter’s protection against unreasonable searches. There is also concern it will disproportionately affect minorities due to racial profiling. The Senate voted to remove the entire provision from the bill, but the Liberal government insisted on restoring it and eventually got its way. Justice Minister Jody Wilson-Raybould says she’s confident the measure will survive a court challenge, and some constitutional experts have backed her up on this. The government points to other countries that have random testing, such as Australia and Ireland, and argues those countries have seen a dramatic reduction in impaired driving rates. Critics argue those stats are misleading because they aren’t being compared to a selective testing regime like Canada’s, and point out Canada has also seen sharp declines in impaired driving under the current rules. Roadside saliva testing Canadian police officers can now use roadside screening devices that test saliva for the presence of cocaine, methamphetamine and THC, the main psychoactive ingredient in cannabis. Police will not be able to use random testing for these; they will still need reasonable suspicion before demanding the test. ... THC blood levels Canada will now be setting a “per se” level for THC in the blood within two hours of driving, meaning police can lay an impaired driving charge based solely on the blood test results without needing to further prove impairment. We have long been doing this for blood alcohol levels, laying criminal charges if a driver’s level is above 80 milligrams of alcohol per 100 millilitres of blood. But the science linking THC blood levels to impairment is much weaker than the science on blood alcohol levels, and defence lawyers will almost certainly challenge this once it’s in effect. Medical marijuana patients are also likely to be at the forefront of challenges. The per se levels are set through regulations, not the legislation itself. The government has already proposed its levels, based on nanograms per millilitre of blood: • A THC level between 2 and 5 ng would be a lower-level offence with a fine of up to $1000; • A THC level above 5 ng would come with the same penalties as an alcohol-impaired driving conviction, including mandatory minimum penalties of a $1000 fine on a first offence, 30 days imprisonment on a second offence and 120 days imprisonment on a third offence; • A mixture of a THC level above 2.5 ng and a blood alcohol concentration above 50 mg per 100 mL would have the same penalties as above. Provinces may add additional penalties on top of this. Consuming even small amounts of cannabis shortly before driving could put someone over these limits. Police will be able to stop and compel drivers to undergo breathalyzer tests without reasonable cause ! In other words, the police will be allowed to be unreasonable ! To violate citizen Charter 8 against unreasonable search and seizure. In effect, by "legally" being able to compel citizens to prove their innocence, literally being stopped in the street(driving now being commoner than walking by necessity). Is the Charter Right 7(d) the right to be presumed innocent, at trial, being turned on it's head, by all drivers, in law, being able to be compelled to prove themselves innocent of a Criminal Code offence at the side of the road? All this done, without reasonable cause. Is that a mock trial? Or just a mockery? It was always a minority of drivers who would drive impaired, and from news reports of statistics from Stop Checks, that minority is shrinking. A combination of social pressure and current laws, has brought that about. So, by giving the police this arbitrary power, allowance to violate the Charter, beviolated, in actual practice? Yes and No. How is that you ask? 1. "Power corrupts and absolute power corrupts absolutely." - Lord Action , so while many police officers seeing how this makes their Stop Checks less effective will resist doing this. Others, especially the politically correct, will see how doing breathalyzer tests on sober people will make their shift a more pleasant and equally remunerative. So, why not? Question: Will police seeing a P.A.L. listed on a Stop Check, now decide to require(no reasonable cause needed) breathalyzers? Will such Stop Checks now be done during hunting season on all drivers wearing scarlet/orange/ white or even, say a camo hat or jacket ? Those already criminals in law, simply by possessing, both a P.A.L. and a legally acquired firearm.) This is a chance to get their P.A.L. revoked. So politically correct politicians/MSM would support that. (The Prime Directive is an end goal, means are flexible.) 2. The law permits the police to do unreasonable violations of Sect. 8 of the Charter, but it does not compel them to do so !!! This is very important distinction. Why you ask? (gee whilikers, will your guy's questions never end? :) Because, the citizen has the greatest influence the closer they are to gov't. and that is the municipal one, secondly the provincial will follow them. So, if we have citizens objecting to this, a growing number being subject to such, and then forming groups to pressure their municipal gov't., as a matter of policy not to violate Sect. 8, such a policy will be adopted. Pressure then will be placed on the provincial governments to do the same. Then provincial police and RCMP will have provincial directives to do the same. (Sober Canadians being forced to undergo breathalyzer tests to prove their innocence will cause a decrease in support/trust of the police by sober/peaceful Canadians. A goal of Cult. Marxism, weakening such support (as done by "gun control", too) promotes social/political chaos, which is a requirement for the Marxists seizing absolute power. Totalitarians claim to be the solution to chaos. (chaos they've institigated against all institutions of liberal democracy.) If the municipal/provincial objections to violations of Section 8 mount. So does pressure on Ottawa and the Supremes, who I predict, in a fit of social engineering/Marxist utopianism(a brain parasite infecting some in the legal profession), are more likely than not to succumb to the temptation of ruling this law, "a justifiable" violation of Canadians Charter Rights. If the Supremes see themselves being brought into public disrepute for unreasonable decisions, that will be, in effect, a bulwark for Charter principles, more formidable that the judicial consciences, so often compromised by hubris and Cult. Marxism/post-modernism/identity politics. 3. Citizen resistance via Charter challenges will arise but, given the hubris of many appointees. Having a majority humbled by their moral/political obligation to protect the Rights and Freedoms of Canadians, can no longer be relied upon. The "Living Tree" idea of Constitutional legal ideology in current fashion, is one of utopian totalitarianism. Predicting a Charter challenge ??? 4. If a citizen resistance by non-stop public criticism of this Charter Right violation, even a beta male run Conservative government might repeal it? 5. Given that Stop Checks for impaired driving under T.H.C./M.J. cannabis will not be permitted under C-46. There is a legal double-standard. That will have to be resolved legally or politically. 6.Presumably, some of those who drink and drive will find it "legally safer" to switch to cannabis and drive. It will take decades of evidence of public harm before the difference between legalization and de-criminalization will be acknowledged. 7.Regarding: Stop Checks for THC/cocaine/meth... A number of police dogs trained to detect cannabis and used in much police work will have to be destroyed or retired, due to legalization of cannabis, air ports, points of entry into Canada, street use against fleeing criminals will no longer be allowed, retraining them not practical. However, the only exception, allowing legal use of such dogs would be at Stop Checks. Because, if they smell any of the drugs they've been trained to detect, that will justify a stop/search and requirement of a saliva sample from the driver. (note- if your child smokes pot in your car or is sitting in the back seat, their jacket is, or the upholstery retains enough for the dog to detect, even though your human parent nose can't. You will be required to do a saliva/blood test once the dog reacts. The science and legal challenges to this will complicate policing/Charter trials to the S.C.C. and the life of millions of Canadians for years. Will Canadian governments increase the number of police to deal with this or reduce the amount of police resources allocated to organized and violent crime? Guesses? Municipal taxes would have to rise significantly just to deal with the current Crystal Meth/Opioid crisis. And that isn't happening, even though an estimated 20,000+ Canadians will die from this over the next 5 years. Much police time is now spent doing social work/psych. intervention now or in support of Social Workers who are at physical risk trying to act as clinical psychologists. For those applying for or renewing P.A.L.s all this will be entered on CPIC or related database one way or another. 8.Across Canada, politically correct Police Commissions and City Councils are suppressing police use of "carding" of people of suspicious behaviour in high crime areas of the cities, on the grounds doing so, is racist. To protect against such accusations regarding Stop Checks, requiring testing of those most likely to be sober will be required to "neutralize" their statistics, I predict! Defending Canada against the domestic corruption of utopian totalitarianism, is a siren call, conscripting all citizens. I am not a Constitutional professional, but an amateur one :) So, you be the judge of my initial response to C-46.
